The Supreme Court had said in the Siddiraju case that there is a right of reservation in promotion for the physically disabled. The Supreme Court said that there is no ambiguity in the judgment. The Central Government should issue instructions under Section-34 of the 2016 Act, under which the reservation in promotion for the physically handicapped can be implemented.

The Supreme Court had said that the three-judge Bench of the Apex Court in its decision had held that the Constitutional Bench of the Supreme Court in the Indira Sawhney Judgment had ruled that there would be no reservation in promotion but it would not be applicable for the physically disabled. . That is, there is no bar on giving reservation in promotion to a physically challenged person.
